Terms of Sale & Conditions of Use

These Terms of Sale (“Terms”) govern all orders placed with TIMMA EATS (“TIMMA”, “we”, “us”, or “our”) through the TIMMA mobile application, website, or any other official ordering channel made available by TIMMA. By placing an order, you (“Customer”, “you”, or “your”) confirm that you have read, understood, and agreed to these Terms.
1. About TIMMA EATS
TIMMA EATS is a food service and ordering platform operated in Yaoundé, Cameroon, allowing customers to order meals and other food products for:
- Delivery;
- Takeaway;
- Dine-in;
- Or any other ordering option made available by TIMMA.

2. Acceptance of these Terms
By creating an account, browsing the TIMMA platform, placing an order, or making a payment, you agree to be bound by these Terms.
If you do not agree with these Terms, you should not place an order through TIMMA.
TIMMA may update these Terms from time to time. The Terms applicable to an order are those displayed and accepted by the Customer at the time the order is placed.
3. Customer account
3.1 Account creation
Certain TIMMA services may require the Customer to create or access an account.
Customers may be able to sign in using:
- Google;
- Apple;
- Facebook;
- A telephone number;
- Or another authentication method offered by TIMMA.
A valid telephone number may be required so that TIMMA, the restaurant, or the delivery agent can contact the Customer regarding an order.
3.2 Customer information
Customers are responsible for providing accurate and up-to-date information.
TIMMA is not responsible for problems resulting from:
- an incorrect delivery address;
- an incorrect telephone number;
- an unreachable telephone;
- incomplete delivery instructions;
- or any other inaccurate information provided by the Customer.
3.3 Account security
Customers are responsible for maintaining the security of their account.
TIMMA may suspend or terminate an account where there is reasonable evidence of fraud, abuse, misuse, or violation of these Terms.
4. Products and menu information
TIMMA makes reasonable efforts to ensure that menu descriptions, photographs, prices, ingredients, portions, and other product information displayed on the platform are accurate.
However, the appearance of a meal may differ from photographs displayed on the platform.
Products may also vary slightly due to:
- ingredient availability;
- seasonal ingredients;
- preparation methods;
- portioning;
- or operational requirements.
TIMMA reserves the right to modify, replace, or discontinue menu items without prior notice.
5. Allergies and food intolerances
Customers are responsible for informing TIMMA of any known food allergies, intolerances, or dietary restrictions before placing an order.
Where available, TIMMA may provide information regarding ingredients and allergens.
However, TIMMA does not guarantee that any food product is completely free from traces of allergens, as multiple ingredients may be handled and prepared within the same kitchen environment.
Customers with severe allergies should contact TIMMA before ordering if they require additional information regarding a particular meal.
TIMMA may refuse to prepare or modify a meal where it reasonably believes that doing so could create a food-safety risk.
6. Placing an order
The Customer may select products, quantities, meal options, complements, and other available customizations.
Before confirming an order, the Customer will be shown a summary containing, where applicable:
- Selected products;
- Quantities;
- Customizations;
- Product prices;
- Delivery fees;
- Applicable charges;
- Total amount payable;
- Delivery or collection method.
The Customer is responsible for checking the order carefully before confirming payment.
Once an order has been confirmed and accepted by TIMMA, it may not be possible to modify it.
7. Order acceptance
Submitting an order does not necessarily mean that TIMMA has accepted it.
TIMMA may reject or cancel an order where:
- a product is unavailable;
- the restaurant is temporarily closed;
- the delivery area is unavailable;
- there is a technical problem;
- payment cannot be verified;
- there is suspected fraudulent activity;
- the order contains an obvious pricing or system error;
- or circumstances outside TIMMA’s reasonable control prevent fulfillment.
Where an order has already been paid for and TIMMA is unable to fulfill it, TIMMA will determine the appropriate resolution, which may include a refund or another suitable remedy, subject to applicable law.
8. Prices
All prices displayed by TIMMA are in Central African CFA francs (XAF).
Unless otherwise stated, displayed prices include applicable taxes.
Delivery fees, where applicable, may depend on factors including:
- delivery location;
- delivery zone;
- order value;
- applicable minimum order requirements;
- and operational conditions.
The total amount payable will be displayed before the Customer confirms the order.
TIMMA reserves the right to change prices at any time. Price changes will not affect orders that have already been confirmed and paid for.
9. Promotions and discounts
TIMMA may offer promotional campaigns, discount codes, vouchers, loyalty rewards, free meals, or other special offers.
Unless otherwise stated:
- promotions cannot be exchanged for cash;
- promotions may not be combined;
- promotions may have an expiry date;
- promotions may apply only to specific products, customers, locations, or order types;
- promotional codes may be limited to one use per customer or account.
TIMMA reserves the right to withdraw or cancel promotional benefits obtained through fraud, abuse, technical errors, multiple accounts, or other misuse.
10. Payment
Orders requiring advance payment must be paid before food preparation begins.
TIMMA may accept payment through:
- Mobile Money;
- CamPay;
- Dohone;
- Payment at the restaurant counter for eligible dine-in or takeaway orders;
- Or any other payment method displayed by TIMMA.
TIMMA will not begin preparing an order requiring advance payment until payment has been successfully confirmed.
A payment that fails, expires, is reversed, or cannot be verified may result in the order being automatically cancelled.
11. Order confirmation
Once payment has been successfully verified and the order has been accepted, TIMMA will provide an order confirmation through the application, website, SMS, email, or another available communication channel.
The order confirmation may include:
- Order number;
- Items ordered;
- Total amount;
- Payment status;
- Estimated preparation time;
- Delivery or collection information.
Customers should retain their order number until the order has been completed.
12. Preparation times
Any preparation or delivery time displayed by TIMMA is an estimated time and not a guaranteed deadline, unless expressly stated otherwise.
Preparation times may be affected by:
- the number of orders being processed;
- order complexity;
- ingredient availability;
- kitchen operations;
- staffing;
- technical issues;
- traffic;
- weather;
- or other circumstances beyond TIMMA’s reasonable control.
13. Changing an order
A Customer may request a modification before preparation begins.
Once preparation has started, TIMMA may refuse changes where the modification would:
- cause food wastage;
- create additional costs;
- disrupt kitchen operations;
- or make preparation impossible.
Additional charges resulting from an approved modification must be paid before the modified order is prepared.
14. Cancellation policy
14.1 Before payment
An order may generally be cancelled before payment has been confirmed.
14.2 After payment
Once payment has been confirmed and the order has been transmitted to the kitchen for preparation, the order generally cannot be cancelled by the Customer.
This is because food is prepared specifically for the Customer and is generally perishable and unsuitable for resale.
A Customer who changes their mind after preparation has started will therefore generally not be entitled to a refund.
15. TIMMA EATS non-refundable policy
15.1 General policy
Food orders are generally non-refundable once payment has been confirmed and preparation has started.
This means that TIMMA will generally not refund an order because:
- the Customer changed their mind;
- the Customer ordered the wrong item;
- the Customer ordered too much food;
- the Customer no longer wants the order;
- the Customer is unavailable to receive the order;
- the Customer provided an incorrect address;
- the Customer was unreachable at the time of delivery;
- or the Customer failed to collect a takeaway order within a reasonable period.
15.2 When TIMMA may provide compensation
Although TIMMA operates a non-refundable food-order policy, we understand that genuine mistakes and service failures can occur.
Where TIMMA determines that a significant problem occurred with an order, TIMMA may, at its discretion, provide one of the following remedies:
- replacement of the affected meal;
- delivery of a missing item;
- a replacement meal;
- a complimentary meal;
- a TIMMA credit;
- a discount on a future order;
- partial compensation;
- or, in exceptional circumstances, a full or partial refund.
Compensation is not automatic and is determined on a case-by-case basis.
Where appropriate, TIMMA may prefer to resolve a valid complaint by providing the Customer with a replacement or complimentary meal rather than a cash refund.
15.3 Situations that may qualify for compensation
Examples may include:
- a confirmed item was completely missing;
- the wrong meal was delivered;
- the meal was significantly damaged before reaching the Customer;
- the order was not delivered despite the Customer being available and reachable;
- a significant preparation error occurred;
- or another material service failure is confirmed by TIMMA.
The remedy offered will depend on the nature and severity of the issue.
15.4 No automatic entitlement
A complaint does not automatically create an entitlement to a refund or free meal.
TIMMA may review relevant information, including:
- order records;
- payment records;
- preparation records;
- delivery records;
- photographs;
- communication history;
- and information provided by the Customer.
TIMMA’s decision regarding a discretionary commercial compensation offer will be made based on the circumstances of the individual case, subject to any rights that cannot legally be excluded.
16. Refund process
Where TIMMA determines that a refund is appropriate, the refund will normally be processed through the payment method or process reasonably available to TIMMA.
The time required for the funds to reach the Customer may depend on the payment provider or financial institution.
TIMMA cannot guarantee the processing time of a third-party payment provider.
Where a refund is not appropriate, TIMMA may instead provide a replacement meal, credit, voucher, or another commercial remedy.
17. Delivery
Delivery is available only within areas served by TIMMA.
The applicable delivery zones, delivery fees, minimum order values, and other conditions will be displayed before the order is confirmed.
Customers must provide:
- an accurate delivery location;
- a valid telephone number;
- sufficient directions;
- and, where necessary, a recognizable landmark.
The Customer must remain reasonably available and reachable during the delivery period.
18. Customer unavailable during delivery
The Customer is responsible for being available to receive their order.
A delivery may be considered unsuccessful if the Customer:
- cannot be reached;
- provides an incorrect address;
- provides insufficient directions;
- refuses to receive the order;
- does not answer the telephone;
- is not present at the specified location;
- or requests delivery to a substantially different location.
The delivery agent may attempt to contact the Customer using the telephone number provided.
If the Customer cannot be reached after reasonable attempts, TIMMA may cancel the delivery.
Because food is perishable, the order may not be eligible for a refund in these circumstances.
TIMMA may nevertheless offer a commercial solution at its discretion.
19. Delivery delays
Estimated delivery times are provided for convenience and may change.
A delay does not automatically entitle the Customer to a refund or compensation.
Where a significant delay results from a confirmed TIMMA service failure, the Customer may contact customer support for review.
Delays caused by traffic, weather, road closures, public demonstrations, technical failures, payment network interruptions, accidents, security conditions, or other circumstances outside TIMMA’s reasonable control may not qualify for compensation.
20. Takeaway orders
Customers selecting takeaway are responsible for collecting their orders from the designated TIMMA location.
Customers should collect orders within a reasonable period after receiving notification that the order is ready.
Because food quality may deteriorate over time, TIMMA cannot guarantee the optimal quality of food that has not been collected promptly.
21. Dine-in orders
For dine-in orders, the Customer may be required to provide their order number or confirmation.
Customers are expected to comply with reasonable restaurant rules relating to:
- hygiene;
- safety;
- staff instructions;
- other customers;
- restaurant property;
- and appropriate conduct.
TIMMA may refuse service or require a Customer to leave the premises in cases involving violence, threats, harassment, abusive behavior, property damage, or other serious misconduct.
22. Missing, incorrect or damaged items
If an order contains a missing, incorrect, or significantly damaged item, the Customer should contact TIMMA as soon as reasonably possible.
Where appropriate, TIMMA may:
- send the missing item;
- replace the incorrect item;
- replace the affected meal;
- provide a complimentary meal;
- provide TIMMA credit;
- provide a discount;
- or issue a partial or full refund in exceptional circumstances.
Photographs may be requested to help TIMMA investigate the issue.
23. Food quality complaints
If the Customer believes that a meal has a significant quality issue, the Customer should notify TIMMA promptly after receiving the order.
TIMMA may request relevant information, including photographs and details concerning the meal.
Complaints submitted substantially after consumption may be more difficult to investigate and may not qualify for compensation.
Nothing in this section limits any mandatory rights available to the Customer under applicable law.
24. Abuse of refunds and compensation
TIMMA reserves the right to monitor repeated claims for refunds, free meals, credits, replacements, or other compensation.
Where TIMMA reasonably believes that a Customer is abusing the compensation system, it may:
- refuse discretionary compensation;
- cancel suspicious orders;
- restrict promotional benefits;
- suspend an account;
- terminate an account;
- or take other reasonable measures permitted by law.
This includes situations where a Customer repeatedly claims that meals were missing, incorrect, damaged, or undelivered without sufficient evidence.
25. Fraud and payment abuse
TIMMA may refuse or cancel an order where it reasonably suspects:
- payment fraud;
- use of stolen payment credentials;
- account takeover;
- multiple fraudulent accounts;
- promotional abuse;
- false refund claims;
- or other unlawful activity.
Where appropriate and legally permitted, TIMMA may cooperate with payment providers and relevant authorities in investigating fraudulent transactions.
26. Customer conduct
Customers must not:
- threaten or abuse TIMMA employees or delivery personnel;
- engage in harassment;
- damage TIMMA property;
- use TIMMA for unlawful purposes;
- attempt to interfere with the operation of the platform;
- create fraudulent accounts;
- manipulate promotions;
- or deliberately provide false information.
TIMMA may suspend or terminate access to the service where necessary to protect customers, employees, delivery personnel, partners, or the integrity of the platform.
27. Receipts and order history
A digital receipt may be made available through the TIMMA application, website, email, SMS, or another supported method.
Customers may also be able to access their order history through their TIMMA account.
Customers should retain receipts where they require proof of purchase.
28. Electronic records
TIMMA’s electronic records relating to an order may be used as evidence of:
- the order placed;
- the time of the order;
- products selected;
- payment status;
- order status;
- delivery information;
- and other transaction details,
subject to applicable law.
29. Service availability
TIMMA does not guarantee that every menu item, delivery area, ordering method, or service will be available at all times.
Products may become unavailable without notice due to:
- ingredient shortages;
- kitchen capacity;
- technical issues;
- operational restrictions;
- or other circumstances.
Where a paid order cannot be fulfilled, TIMMA will determine an appropriate resolution in accordance with these Terms and applicable law.
30. Third-party services
TIMMA may rely on third-party service providers for certain functions, including:
- payment processing;
- authentication;
- telecommunications;
- mapping;
- hosting;
- analytics;
- or delivery services.
The availability and performance of these services may be affected by circumstances outside TIMMA’s control.
31. Intellectual property
The TIMMA name, logo, trademarks, application, website, graphics, photographs, text, software, designs, and other TIMMA content are owned by or licensed to TIMMA and are protected by applicable intellectual-property laws.
Customers may not reproduce, modify, distribute, sell, or commercially exploit TIMMA content without prior written authorization.
32. Personal data
TIMMA may collect and process personal information necessary to:
- create and manage Customer accounts;
- process orders;
- process payments;
- deliver orders;
- communicate with Customers;
- provide customer support;
- prevent fraud;
- improve TIMMA services;
- and comply with legal obligations.
Personal information will be handled in accordance with TIMMA’s Privacy Policy.
33. Limitation of liability
TIMMA will take reasonable measures to provide its services properly.
However, TIMMA does not guarantee that the application, website, payment services, ordering system, or other digital services will always operate without interruption or error.
To the extent permitted by law, TIMMA will not be responsible for losses resulting from:
- inaccurate information provided by the Customer;
- misuse of the platform;
- telecommunications or Internet failures;
- third-party payment failures;
- events beyond TIMMA’s reasonable control;
- or circumstances caused by the Customer.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
34. Force majeure
TIMMA will not be responsible for failure or delay caused by circumstances reasonably beyond its control.
Such circumstances may include:
- natural disasters;
- fire;
- flooding;
- major power outages;
- telecommunications failures;
- government restrictions;
- civil disturbances;
- epidemics;
- major traffic disruptions;
- accidents;
- security incidents;
- payment-network failures;
- or other events preventing TIMMA from reasonably fulfilling an order.
35. Customer communications
By placing an order, the Customer agrees that TIMMA may contact them where reasonably necessary to complete or resolve an order.
This may include:
- order confirmations;
- payment notifications;
- preparation notifications;
- delivery notifications;
- calls from delivery personnel;
- customer-service communications;
- cancellation notifications;
- and other transactional messages.
Marketing communications will be handled according to applicable preferences and laws.
36. Governing law
These Terms are governed by the laws of the Republic of Cameroon, subject to any mandatory consumer-protection provisions that may apply.
TIMMA and the Customer agree to first attempt to resolve any dispute amicably through TIMMA’s customer-service channels.
If an amicable resolution cannot be reached, the dispute may be submitted to the competent courts in accordance with applicable law.
37. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
38. Changes to these Terms
TIMMA may update these Terms when necessary to reflect changes to:
- its services;
- its business operations;
- payment methods;
- applicable laws;
- technology;
- or customer-service policies.
The updated Terms will be made available through the TIMMA platform.
The Terms applicable to a particular order are those accepted by the Customer at the time of that order.

When contacting customer support regarding an order, customers should provide their order number whenever possible.
40. Final acceptance
By selecting “Place Order”, “Confirm Order”, “Pay”, “Order Now” or an equivalent button, the Customer confirms that they:
- have read and accepted these Terms;
- have reviewed their order before payment;
- have confirmed the delivery or collection details provided;
- understand that food orders are generally non-refundable once preparation has started;
- understand that compensation is not automatic;
- understand that TIMMA may, at its discretion, provide a replacement meal, complimentary meal, credit, discount, partial refund, or another appropriate remedy where circumstances justify it; and
- agree to comply with TIMMA’s policies and applicable laws.
TIMMA EATS reserves the right to resolve individual customer issues fairly and reasonably while maintaining a consistent non-refundable policy for prepared food orders.
